Welcome to the www.geomitchell.com website (the ‘Website’) terms and conditions. (‘Geo Mitchell’, ‘we’, ‘us’ or ‘our’) All goods and services purchased by the Buyer, hereafter named the ‘Customer’, from the Seller, hereafter referred as to ‘Geo Mitchell’, are subject to the terms and conditions set out here (and the documents referred to on it).
Please ensure you have fully read and understood the terms and conditions before ordering from the website. By placing an order with us you are accepting that you agree with the terms and conditions laid out and are bound by them.
The website is operated by Geo Mitchell Limited, a company registered in England and Wales under company number 10369383, with its registered office at Attlee House, Churchill Lane, Kidderminster, Worcestershire, DY10 3LY.

1.1. The Hemera vaporising diffuser is made from natural wood. The information and images provided aim to accurately represent the actual appearance of the product. However, the grain of the wood cannot be guaranteed, so there is a possibility it may appear different to the images on the website.
1.2. Both the Hemera and Epione diffusers come with a 1 year manufacturer’s warranty. Should the customer discover a fault within 12 months of purchase, please contact Geo Mitchell via email at email@example.com
, or via our sales line on 01562 700869. The diffusers must be kept clean and dry whilst not in use. Please note, after around 3000 hours of use, the ceramic disk within the diffuser may need to be replaced. Replacement discs are not covered by the Warranty as this is a wear and tear part which can easily be replaced. Please contact Geo Mitchell on the details above to discuss a replacement disc.
1.3. The products and information listed on the website are not designed to cure any medical issues. The advice and products sold are designed to complement an already well-balanced lifestyle. Users are advised to seek professional medical assistance in the event that they are suffering from any medical problem.
2. Ordering from the website
2.2. Contracts formed between the customer and Geo Mitchell will be governed according to English Law, and as such, disputes which occur shall be subject to the jurisdiction of the English courts.
2.3. Please ensure when purchasing items that you are aware of the total purchase price. This amount will be confirmed to you on the review your order page and on your confirmation email, and queries regarding pricing should be raised as soon as possible. You are responsible for checking prices at the time the order is placed as prices are subject to change without notice.
2.4. Prices shown on the site are inclusive of VAT; however, you should be aware that an additional delivery charge is applied. The total amount payable, including delivery charge, will be displayed before the order is confirmed by the customer and the order is placed. 2.5. Prices are liable to change without notice, however product price changes will not affect orders which have already been placed and where an order dispatch email has been received. If the price of an item is reduced after an order is placed the difference will not be refunded.
2.6. Certain items on the website may be available as part of promotional offers such as multibuys or in sale. Geo Mitchell reserves the right to modify, alter, discontinue or terminate such promotions at any time for any reason whatsoever without notice to end users.
2.7. All products are subject to availability. If an order is placed and an item is not in stock then an email informing you of this will be sent and that item will be cancelled and refunded.
2.8. The payment card will be debited immediately after the order is accepted. Therefore if any item is subsequently cancelled a refund will then be credited back to your account. Please see the section below titled ‘Security Policy’ for more information about online payment.
2.9. When an order is placed by the customer an email will be sent which acknowledges receipt of the order placed.
2.10. By placing an order via the website or over the telephone the customer agrees to purchase the item(s) in question. Acceptance of the order takes place once the order is dispatched. The contract formed at this point relates to the products purchased by the customer. Geo Mitchell shall inform the customer if there are to be any changes to the order outside the order confirmation email. Please refer to point 2.11. for further details.
2.11. We reserve the right to refuse an order. Such refusal may arise from, but is not limited to, the following situations:
• The item requested is out of stock
• We are unable to authorise payment for the order
• An error in the item information, including pricing or promotion details
3.1. Customers making purchases on the website may choose to register or use the quick check out option. By purchasing an item on the site, you are confirming that you have read and fully understood the terms and conditions laid out.
3.2. The registration process will require personal details which must be complete and accurate for orders to be processed. Failure to provide accurate details can result in a delay or cancellation of your order.

4. Marketing communications

5.5. In the event of an order being lost by a third party, Geo Mitchell bears no liability once it has left their trading premises. Where goods have been received damaged, a refund/ exchange application will be acknowledged if the goods are returned together with their original packaging within 7 days of receipt to: Geo Mitchell Limited, Unit 2 Frederick Road, Hoo Farm Estate, Kidderminster, Worcestershire, U.K. DY11 7RA.
5.6. Where the goods are signed for, the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.
6.1. Ownership of the products will pass to the customer on delivery of goods or upon receipt of full payment (including postage costs) being received by us, whichever is the later.
7.1. The customer shall be deemed to have accepted the goods unless they notify Geo Mitchell within 7 days of their receipt. (This does not affect the customer statutory rights). If no such action has been taken, Geo Mitchell shall consider the products being as described, of satisfactory quality and fit for their purpose, and may not accept any reject at a later date.
8.1. By purchasing goods using a credit or debit card you are confirming that the card being used is yours and that you have no objections to us performing any authorisation checks which we deem necessary.
9. Security policy
9.1. Our Payment Service Provider is Sage Pay (formerly Protx) – the largest independent payment service provider (PSP) in the UK and Ireland.
9.2. Sage Pay provides a secure payment gateway (Level 1 PCI DSS). It is Sage Pay’s utmost priority to ensure that transaction data is handled in a safe and secure way.
9.3. Sage Pay uses a range of secure methods such as fraud screening, I.P address blocking and 3D secure. Once on the Sage Pay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards.
9.4. Sage Pay is PCI DSS (Payment Card Industry Data Security Standard) compliant to the highest level and maintains regular security audits. They are also regularly audited by the banks and banking authorities to ensure that their systems are impenetrable.
9.5. The customer can tell the session is in a secure encrypted environment when they see https:// in the web address, and/or when they see the locked padlock symbol alongside the URL.
10.1. If the goods are to be rejected, the Customer shall comply with the returns procedure defined in clause 10.2. Geo Mitchell will not accept any returned goods should the return not follow the return procedure.
10.2. The Customer must send all returns within 14 days of receipt to: Returns Department, Geo Mitchell Limited, Unit 2 Frederick Road, Hoo Farm Estate, Kidderminster, Worcestershire, U.K. DY11 7RA.
10.3. In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to Geo Mitchell.
10.4. In cases where the rejection is due to an incorrect order from the customer or to dissatisfaction, the Customer is entitled to a full refund. Goods must be returned to Geo Mitchell. However, postage will not be refunded and any additional carrier costs to Geo Mitchell will be deducted from the refund value.
10.5. The refund will be processed within 7 days of refund request. When returning items you are strongly advised to obtain proof or posting. Geo Mitchell cannot accept responsibility for parcels lost in transit.
10.6.Please include the returns note in your parcel. Failure to do this will result in a delay in processing your refund or could mean that we are unable to refund you.
11. Statutory rights
11.1. Your statutory rights are not affected by our returns process.
12. Cancelling your order
12.1. Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been dispatched. If the order has been dispatched prior to the cancellation, the return procedure as defined in clause 10.2 will apply. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for the full payment.

13.1. Geo Mitchell is fully committed to protecting your privacy. All information collected on our website will only be used to process orders and provide you with a more personalised shopping experience.
• Visitor: Any person who visits the Geo Mitchell website.
• Registered user: A visitor who has completed the registration process on the website.
• Newsletter subscriber: A visitor who has submitted their email address in order to receive email marketing communications from Geo Mitchell.
13.2. When browsing the site all visitors will have the opportunity to register with Geo Mitchell as either a ‘registered user’ or ‘newsletter subscriber’. This information will help us better understand your likes and dislikes and enable us to personalise your shopping experience with us.
13.3. In order to make a purchase with Geo Mitchell, all customers will be required to enter their personal details. By purchasing off the site, or registering with Geo Mitchell, you agree to the terms and conditions laid out.
13.4. Details collected upon registration will include your name, e-mail address, postal address and telephone number. We will also monitor registered customers’ site usage, purchasing and traffic patterns to improve the functionality of our website design in addition to the products and services offered.
13.5. The data you submit will be used by Geo Mitchell and our processors to fulfil your order and also to notify you of any functional changes.
13.6. When registering with the site you will have the option to be added to the mailing list where you can be kept up to date on Geo Mitchell news. If you wish to be unsubscribed from this mailing list, but still wish to have a registered account, simply email email@example.com

13.7. Your details may also be shared with our approved branded partners to keep you informed of their special offers. Geo Mitchell will not pass your details to any third party without your express permission.
13.8. Please Note: All personal information held by Geo Mitchell will remain private and secure; this includes all personal information. Card Details will not be passed to third parties.

Geo Mitchell reserves the right to change the data, references, product specifications, pricing or otherwise amend the contents in full or part at any time without notice.
19.2. While Geo Mitchell takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free. We will not be responsible for: any disruption, corruption of any material in transit, or loss of material or data when downloaded onto any computer system.
19.3. The entire liability of Geo Mitchell under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.
